Delays Continue in Animal Cruelty Case

LETHBRIDGE: The animal cruelty case involving April Dawn Irving has once again stalled.

Irving was charged in early 2015, after 201 dogs were seized from her property near Milk River, along with five more that were found dead. The dogs were discovered starving, dehydrated and chained to stakes.

On November 20, a psychiatric assessment was ordered for Irving, to examine her mental state at the time of the alleged offence, to determine if she can be held criminally responsible for her actions.

So far she has yet to attend an appointment, with her lawyer saying she missed the first one because she broke her leg. Crown Prosecutor Erin Olsen noted that the doctor tasked with conducting the assessment has been trying to schedule another appointment with Irving, but with no success. She also raised the question of Irving’s health, asking for proof that she broke her leg and that she’s dealing with a second health issue, which wasn’t revealed in court.

After addressing those concerns, Olsen asked that Irving be taken into custody to move the process along.

While the judge wasn’t willing to take that step at this point, he adjourned the case to February 19, at which time Irving will be required to appear in person and provide proof of her health issues.
