Out of Town Judge and Prosecutor to Oversee Local Murder Case

LETHBRIDGE – The case of a 40-year old Lethbridge man, accused in the death of a nine month old boy, won’t be heard by a local judge or handled by a local Crown prosecutor.

It was revealed Wednesday (Aug 3) morning that there is a conflict in the case, as Tyler Brian Hogan is related to a retired Lethbridge Provincial Court judge.

While defence lawyer Tonii Roulston wouldn’t comment on the relationship, she did explain that when the case returns to court, she may be applying to have the bail hearing moved to Calgary. She noted that the rest of the case would still be heard in Lethbridge, but that a judge and Crown from another jurisdiction would need to be brought in.

That said, Roulston stated that she may ask for a change of venue to be considered at a later date, if she believes the jury pool has been biased in the Lethbridge area.

Hogan was arrested and charged with second degree murder last week, after an autopsy confirmed Austin Wright died of blunt force trauma on April 28, 2016. An investigation found that Austin had been left in the care of his mother’s boyfriend at the time.

Hogan will be back in court August 8.
