Environmental Appeals Board to examine case involving Lee Creek

CALGARY – The Environmental Appeals Board is set to hold a hearing next month to examine a case centered around Lee Creek in Cardston.

Alberta Environment and Parks issued an administrative penatly of $5,000 to Gordon Atkins and Creekworks Ltd. in August of 2016, after he allegedly conducted infilling and re-slopping of the creek without approval in September of 2014.

The Environmental Appeals Board works independently and reviews decisions made by Alberta Environment and Parks. The board is made up of experts from a variety of disciplines.

They are asking anyone interested in making a representation at the hearing — other than the two parties already involved — to submit a request by fax or email before January 20. It’s the responsibility of the applicant to make sure their request has been received. The request should include the name, address, email, and telephone and fax numbers of the person making it. It should also be noted whether the individual intends to be represented by a lawyer or agent, as well as a summary of their interest in the appeal. After receiving that information, the board will decide if that person can make a representation.

Copies of all materials filed with the board in relation to the appeal will be available at the Cardston Public Library and at the office of the Environmental Appeals Board in Edmonton.

The hearing is set for February 15, with a decision expected to follow within 30-days.
