Judge to decide if Lethbridge man should proceed to trial on murder charge

LETHBRIDGE – The decision will be made in December, as to whether or not a 41-year-old Lethbridge man will go to trial for the death of nine-month-old Austin Wright.

Tyler Brian Hogan had a two-part preliminary inquiry earlier this year on a charge of second degree murder, to determine if there was enough evidence for the matter to proceed to trial.

An agent appearing for Hogan’s lawyer acknowledged that the judge handling the case is from out of town, and asked that the decision be set for Dec. 13.

According to Lethbridge Police, on Apr. 28, 2016, EMS responded to a report of a baby in medical distress at a home along the 600 block of 17 Street North. Paramedics arrived to find Austin inside the home, not breathing and in cardiac arrest. They transported him to the Chinook Regional Hospital, where he was pronounced dead.

Following an investigation and an autopsy, which reported Austin died as a result of blunt force trauma not consistent with a fall, Hogan was arrested and charged on July 27, 2016.

Evidence presented during the prelim can not be revealed as it is covered under a publication ban.
