Defence concerned by delays in voyeurism, child porn case

LETHBRIDGE – The lawyer representing an 18-year-old Hong Kong man who is accused of recording adults and children inside the change room at the University of Lethbridge’s pool, is expressing concerns over delays in the case.

Speaking on behalf of his client Wednesday morning, June 27, in Lethbridge Provincial Court, David Cavilla said that it’s been over 90 days since former U of L student Lap Kwan Yue was charged and he has yet to receive full disclosure from the Crown. Cavilla had noted during the last court appearance in May that they were ready to take the next step in the case, once they obtained disclosure.

In response, Crown prosecutor Michael Fox explained that numerous electronic devices were seized from Yue’s home as part of a police investigation, which they are still examining. He said they require more time, adding that they anticipate additional charges being laid that are similar to the ones already in place. The case was then adjourned to the end of July.

According to ALERT Lethbridge, their Internet Child Exploitation (ICE) unit was tipped off about suspicious activity at the University of Lethbridge’s Centre for Sport and Wellness by pool staff and campus security.

A suspect was arrested on Mar. 22 at the pool, with ICE alleging that the individual was filming inside the change room area while it was being used by a youth swim club – the participants of which were between the ages of five and 18. The investigation then led ICE to search Yue’s home, where they found and seized the electronic devices.

Yue was subsequently charged with voyeurism, possession of child pornography, accessing child pornography, and making child pornography.

In a statement from the U of L, they noted that they have rescinded Yue’s registration and prohibited him from returning to campus.
