Lethbridge Man Gets 3.5-Years for Sexual Assault

LETHBRIDGE – A 47-year old Lethbridge man has been given a three-and-a-half year prison sentence for sexual assault.

Following a trial in January, Darius Shawn Chief Body was found guilty of sexually assaulting a 30-year old hearing impaired woman. Justice D.K. Miller found that on March 28, 2013, the victim was jumped from behind by Chief Body and sexually assaulted.

The victim testified that she was completely caught off guard by the attack, and that she never spoke to anyone before being shoved to the ground. She did admit to smoking crack cocaine all day, selling her van to pay for drugs, and stating that she would do anything for money to pay for more.

Chief Body countered by saying that after an evening of drinking he had gone out looking for more alcohol, when he ran into a woman who started talking to him. He claimed that she offered him sexual favours for money, and that they had consentual sex in the bushes next to a house. After they were finished, he stated that he couldn’t find the $20 he had promised her, so he ran away.

Justice Miller rejected Chief Body’s story, saying his evidence wasn’t credible. He noted that the victim’s hearing-aid was no longer working, meaning she couldn’t have carried on a conversation in the dark with Chief Body.

On top of Chief Body’s time in custody, he has also been placed on the sex offender registry for the next 20-years.
