Accused in Lethbridge sex assault trial to take the stand in his defence

LETHBRIDGE – Trevor Pritchard, the man on trial for luring, sexual assault and possession of child pornography, will take the stand in his own defence at his trial in Court of Queens Bench in Lethbridge. 

His lawyer, William Wister, told the court Friday that he had not only advised his client, but that he’d also spoken with the accused’s father.

“I’ve discussed the issue of him testifying, and on numerous occasions I’ve advised him of his right to silence. I’ve advised him of the onus on the Crown to prove all the elements…and he does not have to testify.”

Wister also told Justice Johnna Kubik he had advised Pritchard of her decision on his Corbett Application. Wister made the application two days prior in the hopes that if his client did take the stand, that his criminal background could not be subject to cross examination.

Kubik denied the application, opening up the possibility that his previous convictions could be brought up during the Crown lawyer Sarah Goard-Baker’s cross examination.

“I’m satisfied that his (Pritchard’s) decision on this matter is made free, voluntary and fully informed,” said Wister.

The judge then asked Pritchard whether it was his intention to testify, to which he answered, “Yup.”

Testimony is expected to begin Tuesday, November 27th and could last up to two days.

Pritchard has three prior convictions for sexually assaulting adolescent girls in 2004, 2009 and 2010.
