Possible resolution ahead in Douglas Bagnall case

LETHBRIDGE, AB – There could be a resolution ahead, in the case involving a 63-year-old Lethbridge man charged with several drinking driving related offences.

An agent for Douglas Bagnall’s Edmonton area lawyer William Tatarchuk appeared in Court of Queen’s Bench in Lethbridge Monday, asking that rather proceeding with an arraignment, the matter be adjourned until Jan. 13, 2020.

Steven Osmond told the court that both the Crown and Defense were working towards a date for a disposition, meaning a potential settlement may be reached.

Bagnall has been charged with impaired driving, impaired driving causing death, and dangerous driving causing the death of 42-year-old former Pikanii Nation band councillor, educator, and sobriety advocate Barney Provost. He has been in custody at Lethbridge Correctional Centre since last January and was found fit to stand trial after a forensic assessment was completed last spring.

Bagnall also pleaded guilty to three charges of breach of conditions in September, after he failed to check in with Lethbridge Police on seven occasions and failed to appear in court at least twice as ordered. He was sentenced to 60 days time served.

Provost was killed on June 25, 2018 when a Toyota Corolla driving the wrong way on Highway 3, west of the Highway 509 intersection hit a Chevy Impala, killing the driver and injuring his 12-year-old daughter. His widow Kristy and several family members, along with a representative of MADD Lethbridge have attended every one of Bagnall’s court appearances.
