Province proposes mandatory sexual assault education for new judges

LETHBRIDGE, AB – Lawyers wanting to become provincial court judges in Alberta could soon have another requirement they would need to meet.

The Alberta Government has introduced Bill 14, the Provincial Court Amendment Act, into the legislature.

If passed, it would require those applying for a judgeship in Alberta Provincial Court to complete training on sexual assault law and social context issues before being eligible for appointment.

Justice Minister Tyler Shandro says this would help to ensure that the victims of sexual violence are treated fairly and with respect in the justice system.

“This training will support victims of sexual assault. Instead of being re-victimized, we need to make sure victims are treated with respect and dignity in the pursuit of justice. Sexual assault law education for incoming judges will help do that by improving and building confidence in the justice system.”

It will not be a requirement under this legislation, however, for existing provincial court judges to complete this training. Shandro spoke with Chief Judge Redmond, who assured him that current judges already undergo annual training for a variety of matters, including sexual assault.

Another goal of the legislation is to increase public confidence in the administration of justice, therefore encouraging more reporting of incidents of sexual violence.

Whitney Issik, Associate Minister of Status of Women, says all Albertans deserve a justice system that is unbiased, effective, fair, and respectful.

“Sexual assault law and social context issues education for provincial court candidates will help dispel discredited stereotypical thinking and provide candidates with the knowledge, awareness, and skills to avoid being influenced by attitudes based on stereotypes or prejudice.”

The federal government already requires candidates seeking to become judges in Court of Queen’s Bench to complete education in sexual assault law and social context issues. P.E.I. is the only jurisdiction currently mandating this for its provincial courts.

Similar legislation is currently before the Manitoba legislature.
