Lethbridge man admits to sexual interference involving two teenage boys

LETHBRIDGE – A 32-year-old Lethbridge man has admitted to two counts of sexual interference, after initially pleading not guilty and setting the matter for trial earlier this year.

Cody Tyler Black Forehead entered the guilty pleas Monday morning, July 30, following which the Crown prosecutor withdrew charges of sexual assault. His four-day trial had been scheduled for this upcoming December.

Black Forehead admitted that on Apr. 27, 2017, he met a 15-year-old boy on Facebook Messenger, and he invited the youth to go drinking with him. The youth agreed and brought another 15-year-old boy along.

After meeting at Black Forehead’s downtown apartment, the three started drinking alcohol and smoking marijuana that Black Forehead provided.

It was noted that he asked the youths what grade they were in – to which they responded Grade 9 – and one of the youths remembered saying he was 15 as well.

One of the youths reported that after becoming intoxicated, Black Forehead started kissing him and that he leaned away to avoid the contact. As the night progressed, Black Forehead performed sexual acts on both teens, and tried to get one of them to have sex with him.

The next morning the boys woke up naked and Black Forehead told them that they should do it again.

Both boys told authorities that they did not want to have sexual contact with Black Forehead.

After having the facts entered before the court, defence lawyer Scott Hadford requested a pre-sentence report (PSR) for his client, along with a Gladue report that will examine Black Forehead’s Aboriginal heritage and how it may have impacted his life and actions. The PSR will also include a risk assessment to determine Black Forehead’s future likelihood of committing a similar offence – something Hadford says he expects to yield positive information for his client.

The matter was then adjourned to Aug. 27, at which time they anticipate being able to schedule a date for sentencing. It was noted that sentencing won’t happen soon, as the preparation of all of the reports is expected to take roughly 16 weeks.

Black Forehead remains out of custody on $2,000 bail, under conditions that he report to police, that he not consume drugs or alcohol unless prescribed by a doctor, and that he have no contact with anyone under the age of 18 unless in the company of another adult.
