Charges updated in fatal November Highway 3 collision

LETHBRIDGE, AB – A man charged in a fatal Highway 3 collision has had those charges replaced.

RCMP say that 36-year-old Wesley Brian Phillips, of Lethbridge, was originally charged with refusal to provide a blood sample.

That charge has since been replaced with four criminal charges, following an investigation by the Coaldale RCMP.

Phillips is now charged with:

· Failure or refusal to comply with a demand resulting in a collision causing death – contrary to Section 320.15(1) of the Criminal Code.

· Operation of a motor vehicle while impaired/over 80mg% causing death – contrary to Section 320.15(3) of the Criminal Code.

· Dangerous operation of a motor vehicle causing death – Contrary to Section 320.13(3) of the Criminal Code.

· Fail to comply with a probation order – contrary to Section 733.1(1) of the Criminal Code.

On November 25, 2019, a 66-year-old woman from Coalhurst was killed along Highway 3 at the intersection leading into Coalhurst. Two vehicles were involved in the collision.

Coaldale RCMP say Phillips’ matters have been put over to Lethbridge Provincial Court for February 14.
