Proceedings will return to Lethbridge court for pop-up injection site operator

LETHBRIDGE, AB – The appeal to return to Lethbridge Provincial Court for Timothy Slaney has been approved after charges were dropped in April 2021.

In September 2020, Timothy Slaney with the Lethbridge Overdose Prevention Society, along with other group members, set up an unauthorized tent in Galt Gardens and other sites with the goal of assisting those who were using illicit substances.

This immediately followed the closure of the Supervised Consumption Site.

The City of Lethbridge issued 17 tickets to Slaney for erecting tents or other structures in a park without permits.

Charges were dropped in April 2021 after the prosecution failed to appear in court multiple times.

Anthony Purgas, representing the City of Lethbridge, filed the appeal Thursday because the defence failed to notify prosecution of the intention to dismiss the tickets.

Amy Matychuk, representing Slaney, says the defence was not required to contact the crown.

After deliberation, the judge ruled in favor of Purgas, stating Section 4.63 of the Provincial Court Act required notice to dismiss the tickets.

Proceedings will return to provincial court at a later date.
