Father found guilty of sexual assault and incest

LETHBRIDGE, AB – A jury of seven women and five men took just three -and -a -half hours to find a 54-year-old Raymond area man guilty of sexual assault, sexual interference, invitation to sexual touching and incest involving his biological daughter.

The assaults took place between 2013 and 2018 when the girl was between the ages of 9 and 13. The girl, her mother, police officers and other family members took the stand last week, describing in detail the myriad of incidents that occurred in three family homes, in the father’s truck and in a trailer while camping.

As the verdict was read out, the father held his head in his hands in the prisoner box, while supporters/family members sat behind him; one woman audibly sobbing at the outcome.

The young girl’s family, including her mother, sat on the opposite side of the courtroom as Crown Prosecutors Tom Brannen and Michael Fox asked that the man be remanded into custody. Defense Lawyer Wade Hlady asked for his client to be free until sentencing on compassionate grounds as a close family member was in the hospital undergoing surgery.

The Crown however, argued that the man’s presumption of innocence was gone, and that he had been convicted of “a most serious set of offences.”

According to the Criminal Code of Canada, incest carries a maximum 14 year and minimum five year prison sentence if the complainant is under the age of 16, while sexual assault involving someone under the age of 16 carries a maximum 14 year and minimum 1 year sentence.

Justice M.P. Sullivan agreed with the Crown, revoking the man’s bail. The defense has asked for a Pre-Sentence Report (PSR), while sentencing was set for April 24, 2020.

As the man was escorted out of the courtroom by Sheriffs, he gave a ‘thumbs up’ to his supporters and family members.
