Southern Alberta man sentenced for domestic assault

LETHBRIDGE, AB – A local man will have an extra 60 days added to his multi-year term in custody.

He cannot be named due to a publication ban.

In August 2018, he lived in Barrons with his then-wife and two children, a teenaged girl and a pre-teen boy.

The couple got into an argument, reportedly regarding previous allegations that the daughter had previously made. The exact nature of the allegations was not specified in court proceedings Wednesday.

The man pushed the woman and put his hands around her neck.

Their son witnessed the assault and told his father to stop. At this point, the father threw his cell phone at his wife.

Crown Prosecutor Dawn Janecke outlined the man’s prior criminal record, which includes convictions for two separate domestic assaults against his wife in 2011 and 2016, a failure to comply with conditions, a trio of weapons-related offences in 2019, convictions for two matters relating to sexual activity with youths in 2021, and an attempt to flee Canada back to his native Mexico in 2021.

For the final two matters listed above, the man is currently near the beginning of a sentence of seven years and three months.

The crown had suggested a period of incarceration of four-to-six months for one count of assault with no additional probation terms to what he is already facing.

The judge ended up siding with the defence, who argued that the man was already serving a lengthy prison sentence, so adding an extra few months would not accomplish much.

He was sentenced to 60 days in custody to be served concurrently and no further probation terms.
