Judge calls impaired driving case “exceptionally egregious”

LETHBRIDGE, AB – A Lethbridge Provincial Court judge called the circumstances surrounding an impaired driving case just before Christmas so bad, she imposed a harsher sentence on a 63-year-old man than either the Crown or the Defense requested. Timothy Jacob Entz pleaded guilty to impaired driving in Lethbridge Provincial Court Tuesday morning (Jan. 28).

According to the Crown, sometime after 5 p.m. Dec. 23, 2019 Entz was driving his vehicle northbound along Highway 4, when he was observed crossing two lanes of traffic from shoulder to shoulder. He came to a stop in the middle of the two lanes, blocking traffic.

According to police who arrived on the scene, Entz was passed out in the driver’s seat, his car still in “Drive,” but with his foot on the brake. RCMP were so concerned about his health, that an ambulance was called, and he was taken to hospital where he was assessed by a doctor and treated.

Two and a half hours after he was admitted, his blood alcohol level was measured at .23 – or just shy of three times the legal limit. Both the Crown and Defense asked Judge Kristin Ailsby to impose a $2,500 fine and a one -year driving prohibition.

However, Ailsby told the court, she was shocked at the information presented, that it was just before Christmas when people were travelling home and that the only thing stopping Entz’s vehicle from continuing on the highway in an extremely dangerous manner was hit foot on the brake pedal- even though he was unconscious.

“I find the circumstances exceptionally egregious,” she told both lawyers.

Ailsby imposed a $3,000 fine, a victim surcharge, told Entz he must get an Interlock device at the first opportunity, and a one-year driving prohibition.
