Sexual Assault Trial Ends in Guilty Verdict for Lethbridge Man

LETHBRIDGE: Darius Shawn Chief Body has been found guilty of sexual assault, for an incident dating back to 2013.

Following the trial, Justice D.K. Miller found that sometime after 3-AM on March 28, 2013, the 30-year old hearing impaired victim was jumped from behind by Chief Body and sexually assaulted.

The victim testified that she was completely caught off guard by the attack, and that she never spoke to anyone before being shoved to the ground. She did admit to smoking crack cocaine all day, selling her van to pay for drugs, and stating that she would do anything for money to pay for more.

Chief Body countered by saying that after an evening of drinking he had gone out looking for more alcohol, when he ran into a woman who started talking to him. He claimed that she offered him sexual favours for money, and that they had consentual sex in the bushes next to a house. After they were finished, he stated that he couldn’t find the $20 he had promised her, so he ran away.

Justice Miller ultimately decided that Chief Body wasn’t believable, and that his claim of having a conversation with the victim didn’t make sense, as she said her hearing aid had died earlier, making her completely deaf.

A pre-sentence report has been ordered for Chief Body, with sentencing set for March 18, 2016.
