Lethbridge man admits to child luring and sexual interference

LETHBRIDGE – A 33-year old Lethbridge man has admitted to charges of child luring, sexual contact with a person under the age of 16 and breaching release conditions.

Joseph Javin Birky was charged in June of 2015, following a lengthy investigation by the Lethbridge Police Service.

They learned that in the fall of 2013, a man met a 13-year old girl online through Instagram. After exchanging messages, the two started chatting online and he propositioned her for sex. It’s then alleged that he sexually assaulted her on multiple occasions between November of 2013 and January of 2014.

Birky – who was given three years in prison in 2010, after admitting to exchanging drugs and money for sex with two girls, who were just 15 and 11-years old – will remain out on bail leading up to sentencing.

As part of his release conditions, Birky is under a 24-hour curfew with exceptions for work, scheduled appointments, or when he is with his parents. He is also prohibited from having contact with anyone under the age of 18, taking on a job or volunteer position that involves kids, and he must avoid locations where there’s a reasonable expectation that children may be present, such as parks and playgrounds.

The case will be back in court January 11, 2017.
